Welcome to Dakota Sanitation. By using our website, placing an order, or using any of our dumpster rental services, you agree to the following terms and conditions. Please read them carefully before engaging our services.

Scope of Services

Dakota Sanitation provides dumpster rental services including, but not limited to, roll-off dumpster delivery, pickup, and disposal for residential, commercial, and construction projects. The specific terms of each rental (container size, rental duration, weight limits, and pricing) are outlined at the time of booking and confirmed in your rental agreement.

Rental Agreement

Each dumpster rental is governed by a separate rental agreement provided at the time of booking. That agreement specifies the rental period, container size, included tonnage, overage rates, and any applicable fees. In the event of a conflict between these Terms of Service and your individual rental agreement, the rental agreement will take precedence.

Pricing and Payment

All prices quoted are subject to change and may vary based on location, container size, waste type, and project duration. Payment is due at the time of booking unless otherwise arranged. We accept major credit cards and other payment methods as specified during checkout.

Additional charges may apply for the following:

  • Exceeding the included weight allowance
  • Extending the rental period beyond the agreed-upon duration
  • Requiring additional pickups or swap-outs
  • Disposal of prohibited or specialty waste materials
  • Dry runs caused by blocked access to the delivery or pickup location

Permitted and Prohibited Materials

Customers are responsible for ensuring that only approved materials are placed in the dumpster. Prohibited materials generally include hazardous waste, liquid waste, asbestos, paint, chemicals, tires, batteries, medical waste, flammable substances, and any items restricted by local, state, or federal regulations.

If prohibited materials are found in the container, Dakota Sanitation reserves the right to refuse pickup, charge additional fees for proper handling and disposal, or return the container to the customer at the customer’s expense.

A complete list of prohibited materials is available upon request and may also be included in your rental agreement.

Placement and Access

The customer is responsible for designating a suitable placement location for the dumpster that provides safe, level ground and adequate clearance for delivery and pickup. The placement area must be accessible to our trucks at all times during the rental period.

Dakota Sanitation is not responsible for damage to driveways, pavement, landscaping, underground utilities, or other property resulting from normal dumpster placement and removal operations. If you have concerns about surface protection, please let us know before delivery so we can discuss available options.

Customers must obtain any necessary permits required by their municipality for placing a dumpster on public property, including streets, sidewalks, or rights-of-way. Dakota Sanitation can provide guidance on local permit requirements but is not responsible for securing permits on the customer’s behalf.

Rental Period and Extensions

The standard rental period is specified in your rental agreement. If you need the dumpster for a longer period, contact us to arrange an extension. Additional daily or weekly fees may apply for extensions beyond the original rental period.

If a dumpster is not available for pickup at the scheduled time due to blocked access, overfilling, or other customer-caused delays, additional fees may be assessed.

Loading Guidelines

Dumpsters must not be filled above the top edge of the container. Overloaded dumpsters present safety hazards during transport and may result in additional charges, a required offload before pickup, or refusal of service.

Waste must be distributed evenly within the container. Concentrated loading on one side can create unsafe conditions for transport and may result in delays or extra fees.

Customer Responsibilities

By renting a dumpster from Dakota Sanitation, you agree to the following:

  • Use the dumpster solely for its intended purpose of waste disposal
  • Refrain from placing prohibited materials in the container
  • Keep the dumpster accessible for scheduled pickup
  • Comply with all local ordinances, HOA rules, and permit requirements related to dumpster placement
  • Notify us promptly if the dumpster is damaged, stolen, or if any issues arise during the rental period
  • Ensure that no one enters, climbs on, or plays around the dumpster

Liability and Indemnification

Dakota Sanitation carries appropriate insurance coverage for our operations. However, the customer assumes responsibility for any injury, loss, or damage that occurs on or around the customer’s property in connection with the rented dumpster, except where caused directly by the negligence of Dakota Sanitation or its employees.

The customer agrees to indemnify and hold Dakota Sanitation harmless from any claims, damages, or expenses arising from the customer’s misuse of the dumpster, disposal of prohibited materials, or failure to comply with these terms.

Cancellation and Refund Policy

Cancellations made prior to delivery may be eligible for a full refund. Cancellations made after delivery has been scheduled or completed may be subject to a delivery fee or partial refund, depending on the timing and circumstances.

Please contact us as soon as possible if you need to cancel or modify your order.

Force Majeure

Dakota Sanitation is not liable for delays or failure to perform due to circumstances beyond our reasonable control, including severe weather, natural disasters, road closures, equipment failure, government restrictions, or other unforeseen events.

Intellectual Property

All content on the Dakota Sanitation website, including text, graphics, logos, images, and software, is the property of Dakota Sanitation or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from our website without prior written consent.

Privacy
